Agreement to Terms

By accessing or using SniperPulse (the "Service"), including our mobile application and website, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Age Requirement

You must be at least 18 years of age to use the Service. By using SniperPulse, you represent and warrant that you are at least 18 years old. If you are under 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Description of Service

SniperPulse provides precision rifle training tools, including:

• Mobile application for stability tracking and training analysis
• Website with educational content, blog articles, and gear recommendations
• Browser-based training games and simulations
• Online courses through SniperPulse Academy (learn.sniperpulse.com)
• Optional cloud sync for training data

Assumption of Risk

BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT:

• Firearm handling, even during dry fire practice, involves inherent risks including serious injury or death
• You voluntarily assume all risks associated with firearm handling and training activities
• You are solely responsible for ensuring safe handling practices at all times
• SniperPulse provides training tools only and does not supervise your training activities
• You will comply with all local, state, and federal laws regarding firearms

User Responsibilities

Safe Use

You agree to:

• Follow all firearm safety rules without exception
• Ensure firearms are unloaded and verified clear before any dry fire training
• Use the app only in a safe environment with an appropriate backstop
• Never point a firearm at anything you are not willing to destroy
• Store firearms securely when not in use

Account Security

If you create an account, you are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access or security breach.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or modify the application
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Impersonate others or misrepresent your affiliation
• Use the Service to promote illegal activities
• Scrape, harvest, or collect user data without authorization

Intellectual Property

The Service and its original content, features, and functionality are owned by SniperPulse and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without explicit permission
• Use our trademarks, logos, or branding without authorization
• Create derivative works based on our content
• Remove any copyright or proprietary notices

User Content

If you submit content to the Service (such as feedback, suggestions, or forum posts), you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and distribute that content in connection with the Service.

You represent that you own or have the right to submit any content you provide and that it does not violate any third-party rights.

If you enroll in courses through SniperPulse Academy:

• We reserve the right to update or modify course content

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR RELIABILITY OF TRAINING DATA, METRICS, OR ANALYSIS
• UNINTERRUPTED OR ERROR-FREE OPERATION
• IMPROVEMENT IN SHOOTING PERFORMANCE OR COMPETITION RESULTS
• COMPATIBILITY WITH ALL DEVICES OR OPERATING SYSTEMS

Training results vary based on individual effort, skill level, and practice frequency. SniperPulse is a supplementary training tool and does not guarantee any specific outcomes in competition, hunting, or skill development.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNIPERPULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• Personal injury, death, or property damage arising from firearm use
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the Service
• Damages exceeding the amount you paid for the Service in the past 12 months

Indemnification

You agree to defend, indemnify, and hold harmless SniperPulse and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any injury or damage resulting from your firearm handling

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date.

Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Conduct that we believe is harmful to other users or the Service
• Requests by law enforcement or government agencies

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will survive (including ownership, disclaimers, indemnification, and limitations of liability).

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SniperPulse regarding the Service and supersede any prior agreements.
